1. Nature of the service

VigilDocs is a software tool that uses artificial intelligence to assist in the drafting of health and safety documentation, including Risk Assessments, Method Statements, Construction Phase Plans and Toolbox Talks. All output is a draft template intended as a starting point for review by a competent person.

VigilDocs does not provide legal advice, engineering advice, occupational hygiene advice, or health and safety consultancy. No solicitor–client, consultant–client or advisory relationship is created by your use of the service.

2. No substitute for competent supervision

Nothing generated by VigilDocs replaces the judgement of a competent person as required under the Management of Health and Safety at Work Regulations 1999, the Construction (Design and Management) Regulations 2015, or any equivalent legislation in your jurisdiction.

Every document must be reviewed, amended, verified and formally approved by a suitably qualified and experienced individual before it is issued, briefed or relied upon at any workplace.

3. Statutory responsibility remains with you

Employers, duty holders, principal contractors and self-employed persons retain full and non-delegable statutory responsibility for workplace health and safety at all times. Use of VigilDocs does not transfer, reduce, share or discharge any of those duties.

You are solely responsible for ensuring that the documents you produce are suitable and sufficient, site-specific, current, and correctly implemented, briefed and monitored.

4. Accuracy of AI-generated content

AI systems can produce content that is incomplete, outdated, inaccurate or inapplicable to your circumstances. Hazards may be omitted, control measures may be inappropriate, and cited legislation may be superseded or irrelevant to your jurisdiction.

VigilDocs makes no warranty, express or implied, that any output is accurate, complete, compliant, fit for purpose, or suitable for any particular task, site or environment.

5. Limitation of liability

To the maximum extent permitted by law, VigilDocs, its owners, officers, employees, contractors and suppliers accept zero liability for any loss, injury, illness, death, property damage, business interruption, enforcement action, improvement or prohibition notice, HSE or regulatory fine, prosecution, civil claim, or any direct, indirect, incidental, special, consequential or punitive damages arising from or connected with the use of this service or of any document it generates.

This limitation applies regardless of the legal theory advanced, whether in contract, tort (including negligence), statute or otherwise, and whether or not VigilDocs was advised of the possibility of such loss.

Nothing in this disclaimer excludes or limits liability which cannot lawfully be excluded or limited, including liability for death or personal injury caused by our own negligence or for fraudulent misrepresentation.

6. Indemnity

You agree to indemnify and hold harmless VigilDocs and its personnel against all claims, demands, proceedings, losses, damages, costs and expenses arising out of your use of the service, your reliance on generated documents, or your failure to obtain competent review prior to use.

7. No professional certification

VigilDocs is not an accreditation body. Documents produced through the platform are not certified, approved, audited or endorsed by any regulator, awarding body or health and safety scheme. Any reference to legislation or guidance is provided for convenience only.

8. Your data and uploads

You are responsible for the accuracy and lawfulness of the project data, personnel details, signatures, logos and imagery you upload. Do not upload information you are not entitled to share, and ensure you have a lawful basis for processing any personal data recorded in attendance registers.

9. Changes to this disclaimer

This disclaimer may be updated at any time without individual notice. Continued use of the service after any change constitutes acceptance of the revised terms.

10. Governing law

This disclaimer and any dispute arising from it are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, save where mandatory local law provides otherwise.
